On top of Meta's rules come the personal data protection laws of each country in the region, which generally ask for the same thing as the platform: informed consent, a clear purpose and the right to unsubscribe. The practice that complies with Meta (recorded opt-in, instant opt-out) also leaves you in good standing with your local regulator; even so, check your country's rules with your legal advisor.

Meta protects WhatsApp as a channel because its value lies in attention: messages average an open rate close to 98%, according to the WhatsApp Business Blog, and that only holds up if users do not see the channel as spam. How to handle opt-in and opt-out without friction

Opt-in is not an awkward legal formality: it is a quality filter for your contact base. A contact who agreed to receive your messages opens, replies and buys; one who never asked for them blocks you. Capturing it well from the start makes everything else (open rate, conversion, your number's quality rating) work better.

The capture points that work best:

  • At checkout or customer sign-up: a dedicated checkbox for WhatsApp (not buried in the terms and conditions), with the purpose spelled out: offers, news, order tracking.
  • In the inbound conversation: if the customer messaged you first, you can ask for marketing opt-in in that same chat and record it.
  • In campaigns and QR codes: click-to-WhatsApp ads, QR codes on the packaging or in the store, web forms. The first message confirms the subscription.
  • The record matters as much as the capture: store the date, channel and consent text for every contact. It is your evidence before Meta and before the regulator.

Opt-out is sacred: a keyword (STOP, UNSUBSCRIBE) has to be enough to stop receiving messages, instantly and with no questions asked.
